Information vs investment advice: where the line sits

Information describes what is true: prices, moves, how an instrument works, and what an order would do. Investment advice tells a particular person what they ought to do, such as buy, sell or hold, or implies what a price will do. Personalisation, timing and ranking are the grey areas. Legal definitions vary by jurisdiction.

This guide sets out the working distinction, shows paired examples, and covers the grey areas that cause most trouble for people and for AI agents. It is not legal advice. Each market needs its own legal review.

The working distinction

Two tests separate most cases.

  • Does it describe, or does it direct? “ETH is down 4.2% today” describes. “Sell your ETH” directs.
  • Is it about the past and present, or about the future? “Funding has been positive for a week” is a record. “Price is heading higher” is a forecast.

Information can be detailed, specific and even personal while still describing. Advice usually contains a verdict, an instruction or a prediction aimed at the reader.

Paired examples

Each row shows the same topic phrased both ways. The advice phrasings are quoted to show what crosses the line.

Examples use illustrative prices and times.

The information column is not vague. It contains numbers, the trader’s own position and specific mechanics. Being on the information side does not mean saying less. It means not deciding for the reader.

Why definitions vary by jurisdiction

There is no single global definition of investment advice. Several things differ between markets.

  • What counts as a recommendation. Some rules focus on whether a statement is presented as suitable for a specific person. Others look more broadly at any statement that could influence a decision.
  • Which products are covered. Crypto assets may be classified as securities, commodities, payment instruments or something else, depending on the market and the asset.
  • Who needs a licence. Rules differ on which firms may give advice, and on what a firm without that permission may say.
  • How rules change. Crypto regulation is developing in many markets, so a line drawn today may move.

That is why no responsible agent or vendor claims to be compliant everywhere. The accurate claim is narrower: an agent can be designed to stay on the information side of the line, and each market still gets its own review. Nothing in this guide is a statement of law in any jurisdiction.

The grey areas

Most real questions fall in three grey areas. They need deliberate design, not just a word list.

Personalisation

Using a trader’s own data is often necessary to be useful. “What would closing half my position cost in fees?” cannot be answered without the position.

The line sits at what is done with that data. Stating balances, sizes, margin and fees is information. Telling that trader whether the position is too large, or what to do with it, is advice. An agent can show the facts that bear on a choice without making it.

Timing

Timing is where implied advice hides. Nothing in “the decision is on Wednesday” is advice. Putting it next to “so traders are positioning ahead of it” starts to suggest an action. Adding urgency language crosses the line.

A useful pattern is to give scheduled events and recent history as facts, then stop. The trader draws the conclusion.

Ranking

Lists are natural answers, so ranking comes up constantly. Ranking by an objective, stated measure is information: “largest by 24-hour volume”, “highest funding rate right now”. Ranking by quality or attractiveness is a verdict: “best”, “strongest”, “most promising”.

The test is whether the ranking criterion is a measurable fact the reader can check.

How this applies to AI trading agents

An AI agent faces these questions at scale, phrased many ways, sometimes under deliberate pressure. Three design choices keep it on the information side:

  1. Answer patterns that describe. Facts with sources and timestamps, factors traders watch, and the exact effect of an order.
  2. Blocked phrasings, enforced and tested. A list of recommendation, prediction and certainty language, checked at output and in a large advice-bait test suite.

Frequently asked questions

Is explaining how an order type works investment advice?

Generally no. Describing how a market, limit or stop order behaves is information about a tool. It becomes closer to advice when it is tied to a specific person's situation as a recommendation to use it now.

Is it investment advice to say a coin rose 10% this week?

A sourced statement of what happened in the past is information. Adding a verdict, such as that the rise makes the coin worth buying, or a forecast of what comes next, moves it toward advice.

Why do definitions of investment advice differ between countries?

Each jurisdiction writes its own rules about what counts as a personal recommendation, which products are covered, and who needs a licence to give one. Crypto assets are also classified differently across markets.

Can an AI agent personalise answers without giving advice?

It can use a trader's own data to state facts, such as current balances, position size or the margin an order would use. Personalisation turns into advice when the agent tells that trader what they ought to do with those facts.
